Cabinet approves proposed trademark law changes

The Cabinet passed a set of draft amendments to the Trademark Act Dec. 16 aimed at enhancing trademark protection and creating a better investment environment in Taiwan.

The revisions include an expansion of the scope of items that can be trademarked to encompass nontraditional forms, such as holograms and motion marks used on mobile phone screens.

Other proposed changes include trademark registration fees, common trademarks, proof of usage in the trademark application and cancellation process, and trademark infringement rules.

Premier Wu Den-yih said the government’s moves to strengthen intellectual property rights protection, including trademarks, would help ensure a smoothly functioning marketplace and the rights and interests of enterprises.

“This will increase Taiwan’s attractiveness as an investment destination,” Wu said.

Wu added that the revisions, pending legislative approval, are necessary in terms of meeting the needs of industry development and bringing Taiwan’s trademark regulations into line with international norms.

The Ministry of Economic Affairs, which oversees trademark policies, said the draft revisions are designed to facilitate the development of Taiwan’s industry and commerce, and boost the country’s international competitiveness. (SB)
